From Thursday nights debate, Global Test? Kerry Failed the Constitutional Test.

This has probably been picked apart in other parts of the Blogosphere, but here’s my 2 cents worth. In Senator Kerry’s remarks about the “Global Test,” he had some very telling words. Here they are:

“No president, through all of American history, has ever ceded, and nor would I, the right to preempt in any way necessary to protect the United States of America. But if and when I do it, Jim, you have to do it in a way that passes the test, that passes the global test where your countrymen, your people understand fully why you’re doing what you’re doing and you can prove to the world that you did it for legitimate reasons.”

No president has done it before, but if and when I do it….. You can’t get too much more self-damning words than that.

He has already in his mind committed this action, to submit the action of acting in the interests of the United States to other countries, even though those countries probably have interests against ours, so any action by us would be against their interests, such as France and Germany in the case of Iraq. Which means we wouldn’t pass that vaunted “Global Test” and thus we (Possibly President Kerry) would not react to a second smoking crater in New York, or a mushroom cloud.

That’s the man whom the Democrats want to put into office.

Finally, a good landmark case, heavy on the “land.” Too Late For One, SCOTUS Accepts Land Use Case I have already written on this subject here, about the Michigan SC ruling in a similar fashion.

“No person shall be…deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.” That’s the pertinent portion of the Fifth Amendment, and how that clause has been applied by state and local governments these past couple decades is the issue of interest presented the U.S. Supreme Court, via Kelo v. City of New London.

The current interpretation is, “if it increases our tax base, then we can do it.”

Municipalities have for years used Eminent Domain to force people out of their homes in order to build things like business parks, shopping centers and in this case, upscale homes. This was not the intended use of ED, which was to build and develop properties that furthered the public interest, such as roads and schools. Not develop the tax base.

The “one too late” is a lady who has had the land taken out from under her, complete with harassment by mysterious black vehicles, and charges of her stealing the land to begin with.

This, too, should be looked at by the SCOTUS, as it would impact how the Federal Government confiscates land in the name of preservation.

This gave me a laugh, To Our Readers (and Writers).

Here is what got me laughing:

WE RECEIVED THE following letter from a woman in Yonkers, N.Y.: “Dear editor: This debate made it clear: John Kerry is a leader we can trust to tell us the truth when it comes to our nation’s security. George Bush has had his chance; I’m ready for a new direction.”

Cogent, succinct, personal — everything we look for in a letter. So why are we writing about it here, instead of publishing it in the columns to the right? Unfortunately, the letter, perfect in every other way, arrived in our electronic in-box Thursday afternoon, four hours and 14 minutes before debate moderator Jim Lehrer posed his first question.

The article goes on to explain that the DNC told them to write, told them how to write it and gave them what to write.

And write they did. Hundreds to the Washington ComPost, and probably thousands to other major and minor newspapers.

And the Left accuses the Right, especially Talk Radio listeners of being mind numbed robots, unable to think for themselves. We supposedly receive our daily marching orders through the radio and are compelled to carry them out. But this proves that the Left receives “instruction” as well. More so, in fact, than the Right does. At least when the NRA urges me to write my Congressmen and Senators, they tell me what to write about, not what to write.
